Maryland security deposit law
The state rules a landlord in Maryland has to follow for a residential security deposit, from Md. Code, Real Property 8-203.
- Maximum deposit
- One month's rent (two months only in a narrow utility-assistance case).
- Deadline to return it
- Within 45 days after the tenancy ends.
- Itemized deductions
- Written list of damages claimed with an itemized statement of costs, sent by first-class mail within 45 days.
- Interest on the deposit
- Yes: simple interest at the greater of the 1-year U.S. Treasury rate or 1.5% a year, only if held 6 months or more and the deposit is $50 or more.
- Penalty for wrongful withholding
- Up to three times the amount withheld plus attorney fees if withheld without a reasonable basis; landlord loses the right to keep any for damages if the list is not sent.
Before you keep any part of a deposit
- Compare the unit with the move-in inspection and photos. Normal wear and tear is generally not chargeable.
- Keep receipts or written estimates for every deduction.
- Send the return or the itemized list within the deadline above, to the tenant's forwarding address, and keep proof of mailing.
