Arizona security deposit law
The state rules a landlord in Arizona has to follow for a residential security deposit, from Ariz. Rev. Stat. § 33-1321.
- Maximum deposit
- One and one-half months' rent, including prepaid rent.
- Deadline to return it
- 14 days (not counting weekends and legal holidays) after the tenancy ends, possession is delivered, and the tenant demands it.
- Itemized deductions
- An itemized list of all deductions with the amount due, sent by first-class mail to the tenant's last known address.
- Interest on the deposit
- Not required by state law
- Penalty for wrongful withholding
- Tenant may recover the money owed plus damages of twice the amount wrongfully withheld.
Before you keep any part of a deposit
- Compare the unit with the move-in inspection and photos. Normal wear and tear is generally not chargeable.
- Keep receipts or written estimates for every deduction.
- Send the return or the itemized list within the deadline above, to the tenant's forwarding address, and keep proof of mailing.
