Alabama security deposit law
The state rules a landlord in Alabama has to follow for a residential security deposit, from Ala. Code § 35-9A-201.
- Maximum deposit
- One month's rent, except extra amounts for pets, changes to the premises, or increased liability risk.
- Deadline to return it
- 60 days after the tenancy ends and the tenant gives up possession.
- Itemized deductions
- An itemized list of amounts withheld, mailed within the 60 days; the tenant must give a written forwarding address.
- Interest on the deposit
- Not required by state law
- Penalty for wrongful withholding
- Landlord who misses the 60-day deadline owes the tenant double the original deposit.
Before you keep any part of a deposit
- Compare the unit with the move-in inspection and photos. Normal wear and tear is generally not chargeable.
- Keep receipts or written estimates for every deduction.
- Send the return or the itemized list within the deadline above, to the tenant's forwarding address, and keep proof of mailing.
